The petitioners, namely, Rubina Pravin @ Rubina Praveen @ Rubina Begam and Shahnaj Praveen, apprehend their arrest in a case under Sections 307, 302, 120(B) of the Indian Penal Code.
The informant alleged that his son Sandeep Kumar was studying at Kota (Rajasthan). Naqvi Ara @ Roshni, daughter of Md. Kamruzama Siddique, was also studying at Kota. Both developed intimate relationship and the girl became pregnant. It is alleged that later on Md. Karuzama Siddique and his family members brutally assaulted the son of the informant. It is submitted the petitioners are ladies. One of the accused persons, namely, Bilkish @ Bilkish Khatoon (mother of Naqvi Ara @
Patna High Court Cr.Misc. No.20899 of 2016 (2) dt.20-05-2016 2/2 Roshni) has already been granted anticipatory bail vide order dated 14.08.2015 passed in Cr. Misc. No. 18014/2015 but the prayer for anticipatory bail of Md. Kamruzama Siddique and Md. Mohsin @ Mohsin was rejected vide order dated 14.08.2015 passed in Cr. Misc. No. 16860/2015. The police, after investigation, submitted final form finding the case false against the petitioners. The petitioners are aunts of Roshni.
Considering the facts aforesaid and the fact that similarly situated co-accused Bilkish @ Bilkish Khatoon has already been enlarged on anticipatory bail and the case of the petitioners, who are ladies, stands on similar footing, the above named petitioners, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Sri D.K. Mishra, Judicial Magistrate, 1st Class, Siwan in Andar P.S. Case No. 121/2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
