JUSTICE SUDHIR SINGH ORAL ORDER 16-05-2019 Heard learned counsel for the petitioner, learned APP for the State and learned counsel for the informant. The petitioner seeks bail in a case registered under Sections 307/34of the Indian Penal Code and 27 of the Arms Act.

Allegation is that the accused persons including the petitioner fired on the informant, due to which he received fire arm injury on his left hand.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 25.10.2018 and has got no criminal antecedent. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. The nature of injury is said to be simple.

Patna High Court CR. MISC. No.19342 of 2019(3) dt.16-05-2019 2/2 General and omnibus allegation has been made. Injury is on non-vital part of the body.

On behalf of the State and learned counsel for the informant, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. 3rd, Naugachia, District Bhagalpur in connection with Gopalpur (Rangra O.P.) P.S. case No.248 of 2018.
