JUSTICE ASHUTOSH KUMAR ORAL JUDGMENT Date : 09-05-2019 An advertisement was issued in the year 2015 for appointment on 209 posts of Block Coordinators on contract basis under the Bihar State Water and Sanitation Mission. Pursuant to the aforesaid advertisement, the petitioners, who hailed from different categories, applied and were successful. Their names figured quite high in the merit list which was prepared sometimes in the year 2015 only. However, till date, no appointment letter has been issued to them.

On seeking information from the concerned authority viz. the District Magistrate, who is also the Chairman of the District Water and Sanitation Committee as well as from the Mission Director, Lohiya Swachchh Bihar Abhiyan, Rural Development Department, Government of Bihar, the petitioners have learnt that the issuance of appointment letters are pending direction/decision of the Government.

Mr. Nityanand Mishra, learned advocate for the petitioners submits that the process of appointment was completed in the year 2015 but till date, the appointment process is hanging fire for no apparent/good reason. He further admits that no legal right has accrued to the petitioners; nonetheless the petitioners would be entitled to know as to when the process would be completed.

Regard being had to the aforesaid submissions urged on behalf of the petitioners, they are directed to make an application before the District Magistrate-cumChairman, District Water and Sanitation Committee, Madhubani (respondent No. 7) within a period of four weeks from today, who, on receipt of such representation, shall look into the matter and if the process of appointment of Block Coordinators has been completed, he shall seek necessary instructions from the Government and pass/caused to be passed necessary orders within a further period of six weeks thereafter.

5. With the aforesaid observation/direction, the writ petition stands disposed off.
