JUSTICE DINESH KUMAR SINGH ORAL ORDER 08-07-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 420 and 406/34 of the Indian Penal Code.
The prosecution case is that imposter claiming to be Sila Devi wife of Ravindra singh executed sale deed in favour of the informant. The petitioner was identifier of the alleged imposter and thereby the accused persons cheated `5,50,000/- of the informant.
It is submitted by learned counsel for the petitioner that the thrust of accusation is against the person who executed the sale deed but the said lady has not been made accused. However, learned counsel for the informant submits that the petitioner identified the imposter.

No.24739 of 2015 (2) dt.08-07-2015 2/2 Considering the fact that the case has actually not been lodged against alleged imposter and this fact is not verified whether the executant of the sale deed was actually Sila Devi or not, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Kaimur at Bhabua in connection with Bhabua P.S. Case No. 130 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
