Petitioners seek anticipatory bail in Roh P.S. Case no. 102 of 2019 registered for the offence punishable under sections 147, 148, 149, 323, 337, 308, 153A and 353 of the Indian Penal Code.

Learned counsel for the petitioners submits that petitioners are persons of clean antecedent and their names

Patna High Court CR. MISC. No.16491 of 2020(2) dt.21-10-2021 2/2 transpires on the confessional statement of four accused persons who were arrested by the police. Skirmish took place between two communities creating law and order problem. Learned counsel for the petitioners further submits that petitioners were not involved in the occurrence and they have been falsely implicated in this case at the behest of the persons with whom there have been dispute from before and as such they have not been named in the FIR.

Considering the facts and circumstances of the case, this anticipatory bail application is allowed. In the event of arrest/surrender within ten weeks from today, the petitioners are directed to be released on anticipatory bail on furnishing bail bonds of Rs 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Nawada in Roh P.S. Case no. 102 of 2019 subject to the condition under section 438(2) Cr.P.C.
