====================================================== CORAM: HONOURABLE MR. JUSTICE PURNENDU SINGH ORAL ORDER 29-03-2023 Heard Mr. Arun, learned counsel appearing on behalf of the petitioner and Mr. Vinod Shanker Modi, learned APP for the State.

2. Petitioner, who is in custody since 30.04.2019 seeks regular bail in connection with POCSO P.S. Case No. 22 of 2019 arising out of Birpur P.S. Case No. 98 of 2019 registered for offences punishable under Sections 341, 342, 376, 120B/34 of the Indian Penal Code, later on Section 4 of the POCSO Act added.

3. A report was called for regarding stage of trial in connection with POCSO Case No. 22 of 2019 arising out of Birpur P.S. Case No. 98 of 2019 from the Court of learned

Patna High Court CR. MISC. No.16936 of 2023(3) dt.29-03-2023 2/2 A.D.J.-VI-Cum- Special Judge, Supaul.

4. It has been informed by learned A.D.J.-VI-cumSpecial Judge POCSO Act, Civil Court, Supaul that out of fourteen charge-sheet list witnesses, nine prosecution witnesses have been examined. At preset, case is pending for the examination of remaining witnesses including victim herself, I.O. and Doctor.

5. The learned trial Court is directed to conclude the trial expeditiously taking into account the limitation contained in sub-section 2 of Section 35 of the POCSO Act and also the direction of the Apex Court.

6. Accordingly, the present bail application is disposed of.
