The petitioner apprehends his arrest in a case registered for the offences punishable under Section 307 and other allied sections of the Indian Penal Code. As per the FIR, this petitioner assaulted the husband of informant by means of iron rod causing head injury. It is submitted that due to land dispute between the parties, causal marpit took place in which both sides sustained injuries. There is case and counter case. Injury attributed to this petitioner is reported to be simple in nature. Moreover, FIR has been lodged after delay of thirteen days and there is no plausible explanation for the same.

Considering the facts aforesaid, the petitioner above-

Patna High Court CR. MISC. No.17409 of 2022(2) dt.27-09-2022 2/2 named, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate Ist Class, Purnea in connection with Dagarwa P.S. Case No. 71 of 2021, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
