JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 06-02-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Warisnagar ( Mathurapur) Police Station Case No. 210 of 2013 registered for the offences punishable under Sections 147, 323, 33, 341, 353, 307 and 504 of the Indian Penal Code. Petitioner is named in the first information report but in the first information report, it has been mentioned that the informant came to know about the name of the petitioner from others. Furthermore, it is an admitted position that a mob of 40 to 50 persons being armed with lathi and danda snatched the real culprits from the informant and his associated and admittedly, the

Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioner, in the event of his arrest/surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs. 10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st class, Samastipur in Warisnagar (Mathurapur) Police Station Case No. 210 of 2013, subject to condition as laid down under Section 438(2) of the Cr.P.C.
