2. Since both the petitioners herein have preferred their first regular bail applications seeking for grant of regular bail in connection with Nadi (River) P.S. Case No. 330 of 2024 registered for the offence under Sections 103(1), 3(5) B.N.S.
Patna High Court CR. MISC. No.15591 of 2025(4) dt.15-05-2025 2/3 Act, both the applications are being decided by this common order.
3. According to the case of prosecution, one Pappu Kumar son of the deceased lodged a report wherein, it is alleged that on 12.10. 2024 at about 6:00 P.M, present applicants were taken his father namely, Ashok Das with them, then his father did not return. Subsequently, at about 8:00 P.M. his father was found in unconscious condition near the house of Shambhu Rai and he sustained injuries on his head, neck and stomach. He was taken to the hospital for his treatment subsequently, he died. On the basis above information given by the Pappu Kumar, offence has been registered and the applicants were arrested during course of investigation.
4. It is submitted by the learned counsel for the petitioners that the petitioners are innocent and have been falsely implicated in this case. There is no any eye witness in the present case. They have been implicated only on the basis of suspicion. He further submits that applicants are in custody since 14.10.2024. He further submits that charge-sheet has been filed and trial is going on, it will take some more time, therefore they may be granted benefit of regular bail.
5. Learned counsel for the State opposes the
Patna High Court CR. MISC. No.15591 of 2025(4) dt.15-05-2025 3/3 arguments raised by the counsel for the petitioners.
6. Considering the above submissions made by the learned counsel for the petitioners and particularly considering the material available on record, I am of the view that it is not a case where both the applicants should be enlarged on bail.
