JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 20-05-2016 Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State. This application, for grant of anticipatory bail, arises out of Gogri Police Station Case No. 210 of 2014, disclosing offences under Sections 143, 149, 341, 283, 353 of the Indian Penal Code.
Protesting against the murder of one Upendra Gope on 16.09.2014, the public were causing obstruction in free movement of vehicles on road. It is alleged in the First Information Report that one Manoj Yadav was leading the 100-150 protestors against the said killing. It is further alleged that the petitioner and others caused obstruction in due discharge of the official duties of the Police/public servants.

Patna High Court Cr.Misc. No.20588 of 2016 (2) dt.20-05-2016 2/2 submitted that the petitioner is not named in the First Information Report and his name has surfaced in course of investigation and, therefore, he apprehends his arrest. Considering the nature of allegation, this application is allowed.
Let the petitioner, Bablu Yadav, in the event of his arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Shri Brajesh Kumar, Judicial Magistrate, 1st Class, Khagaria, in connection with Gogri Police Station Case No. 210 of 2014, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
This is subject to the condition that the petitioner shall present himself before the police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bond shall be liable to be cancelled.
