The petitioners seek bail in a case registered for offences under Sections 30 (a) of the Bihar Prohibition and Excise Act, 2016.

It is contended that, as per allegation, 1647.220 litres of foreign liquor was recovered from the truck and the petitioners are said to be the driver and assistant driver of the said truck. Petitioners claim that they are having clean antecedent and are in custody since 03.07.2017.

No.51284 of 2017(2) dt.09-11-2017 2/2 Considering the facts and the circumstances of the case, the petitioners, above named, are directed to be released on bail on their furnishing bail bonds of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Additional District & Sessions Judge-II-cum-Special Judge, Excise, Vaishali at Hajipur in connection with Sarai P.S. Case No. 105 of 2017 with a condition that one of the bailors of the petitioner(s) must be the close relative or his family member, who will file affidavit before the court below giving full genealogy showing his or her relationship with the petitioners and the other bailor will be the resident of Bihar since the petitioners belong to Uttar Pradesh. Further, if the petitioners, after their release in this case, are again found to be involved in criminal case of similar nature, the court concerned would be at liberty to take steps for cancellation of his bail bonds.
