Petitioner seeks bail, who is in custody since 05.09.2020, in connection with Balia (Begusarai) P.S. Case No. 35 of 2018, F.I.R. dated 16.02.2028 registered for the offences punishable under Sections 326/34, 307, 341, 279 of the Indian Penal Code and Sections 25(1-AA) and 27(2) of the Arms Act. Learned counsel for the petitioner submits that during the pendency of the bail petition, the petitioner has been acquitted from the charges as alleged in the F.I.R. and hence the petition has become infructuous and seeks permission to withdraw the petition.

Permission is accorded.
