JUSTICE DINESH KUMAR SINGH ORAL ORDER 21-07-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under sections 147,148,149,323,325,307379 and 380 of the Indian Penal Code. The accusation is of assaulting the informant and others and taking away cash of rupees forty thousand, ornaments and clothes.
Since specific accusation of causing grievous injury is against petitioner nos.1 Chetan Kumar, petitioner no. 2 Hari Yadav and petitioner no. 4 Sushil yadav, let the learned court
Patna High Court Cr.Misc. No.25746 of 2015 (2) dt.21-07-2015 2/2 below consider the prayer for regular bail of the petitioner nos. 1,2 and 4 in case the petitioner nos. 1,2 and 4 surrender within six weeks from today in connection with Madhepura (Bharahi) P.S. Case No. 150 of 2015 pending in the court of learned C.J.M., Madhepura. So far as petitioner nos. 3 Chandeshwari Yadav and petitioner no. 5 Sunil Yadav are concerned, since there is no specific accusation against them, there is counter version of the occurrence and Statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent, let the above named petitioner nos. 3 and 5 be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned CJM, Madhepura in connection with Madhepura (Bharahi) P.S. Case No. 150 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
