The petitioner seeks regular bail in connection with Nautan PS case no. 527 of 2018 registered for the offence punishable under Sections 365, 366, 366A/34 of Indian Penal Code.

The allegation is regarding the accused persons having kidnapped the victim girl.

The learned counsel for the petitioner submits that the victim girl, in her statement under Section 164 Cr.P.C. before the learned Magistrate, has stated that she was taken to Siwan after being kidnapped by the accused persons where one of the co-accused namely Raja Alam had forcibly solemnized marriage with her and thereafter had forced himself upon her.

No.17179 of 2019(2) dt.02-04-2019 2/2 The learned counsel for the petitioner thus submits that it is apparent that the petitioner is not having any role in the alleged incident, however he has been implicated in the present case only on account of being mother of the said co-accused person namely Raja Alam. It is further submitted that the petitioner is having clean antecedent and is languishing in custody since 27.11.2018.

Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail.

Accordingly, the abovenamed petitioner is directed to be enlarged on regular bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, West Champaran at Bettiah in connection with Nautan PS case no. 527 of 2018.
