JUSTICE SUDHIR SINGH ORAL ORDER 28-09-2015 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case instituted under Section 302/34 of the Indian Penal Code. It is alleged by the informant that on 3.4.2013 his brother was sitting on a chair including the family of the informant. Thereafter the petitioner came and called the brother of the informant and taken away in orchard and all accused persons assaulted him with lathi and fists, due to which he died. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. The petitioner has been falsely implicated in the present case. From perusal of the case diary it appears that the main allegation is against coaccused Sabbir Khan @ Sabbir Hasan Khan. It is further

Patna High Court Cr.Misc. No.26558 of 2015 (3) dt.28-09-2015 2/2 submitted that co-accused, Sabbir Khan @ Sabbir Hasan Khan, has been granted anticipatory bail by another bench of this Court vide order dated 20.01.2014 in Cr. Misc. No. 41308 of 2013. On behalf of the State, it has been submitted that the petitioner is named in the FIR.

Considering the aforesaid facts, let the above named petitioner, in the event of his arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M.,Saran at Chapra in connection with Panapur P.S.Case No. 20/2013, subject to the conditions as laid down u/s 438(2) Cr.P.C.
