====================================================== CORAM: HONOURABLE MR. JUSTICE RAKESH KUMAR ORAL ORDER 19-09-2017 Heard Sri Ramashray Roy, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, who is in custody since 08.07.2017 in Excise Case no.2441/2017 (arising out of Piro P.S. Case No.164/2017) registered for the offence under Section 37(a), 37(b), 30(a), 56(e) of the Bihar Prohibition and Excise Act, 2016, has prayed for grant of bail primarily on the ground that three co-accused, namely,(i) Kamlesh Kumar Sah@ Lutan Sah @ Lutan (ii) Chandan Tiwary and (iii) Rajesh Kumar @ Rajesh Kumar Sharma have been granted bail on 25.08.2017 vide Cr.Misc.No.39955 of 2017.
Considering the fact that three co-accused in similar circumstances have been granted bail, there is no reason to further detain the petitioner. Let the petitioner, namely, Bablu
Patna High Court Cr.Misc. No.42925 of 2017(2) dt.19-09-2017 2/2 Tiwari be enlarged on bail on furnishing bail bond of Rs.10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of learned 4th Addl.
