The petitioner is languishing in custody since 30.07.2017 in a case for the offence registered under Sections 447, 307/34 of the IPC and 3⁄4 of the Explosive Substance Act. The prosecution story, in brief, is that the informant's son was watering his field for plantation of paddy plant, petitioner and others variously armed with weapons arrived there and started firing with gun. In the meantime, the informant and others also reached there, co-accused Hind Keshari fired from his gun, Sanjany Kumar, Bibyanku Kumar and Pankaj Kumar sustained fire arm injuries. Patna High Court Cr.Misc. No.43055 of 2017 (2) dt.21-09-2017 2/2 petitioner that the petitioner is in custody since 30.07.2017. There is no allegation of tampering with the witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case due to land dispute between the parties. The allegation is that the petitioner threw a bomb but there was no injury caused due to explosive substance on the body of the injured persons. On behalf of the learned counsels for the State and the informant, it has been submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M. Muzaffarpur, in connection with Minapur P.S. Case No. 225/2017. U.K./- (Sudhir Singh, J) U T
