====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY KUMAR ORAL ORDER 23-07-2018 Heard learned counsel for the petitioners and learned A.P.P. for the State.
The petitioners seek regular bail in connection with Garkha P.S. Case No.339 of 2017 registered for the offence punishable under Section 395 of the Indian Penal Code. The informant is an S.H.O. of Garkha Police Station. On receiving information, the police party reached at the place of occurrence where dacoity took place.
It has been submitted that the petitioners are not named in the F.I.R. They along with other co-accused were arrested for which Brahmpura P.S. Case No.81 of 2017 was lodged for the offence under sections 414/34 of IPC and 25(1-b)a/26/35 of the Arms Act. Petitioners allegedly confessed their complicity in the
Patna High Court Cr.Misc. No.37337 of 2018 (3) dt.23-07-2018 above crime and except the said confession there is nothing against them. Nothing has been recovered from possession of the petitioners. The petitioner no.1 has been allowed bail in Brahmpura P.S. Case No.181 of 2017 by this court in Cr.Misc.No.986 of 2018. The petitioners are in custody since 28.08.2017 and so they deserve bail.
The learned A.P.P. for the State opposed the submission.
Considering the facts and circumstances of the case, the prayer of bail is allowed. The petitioners, named above, are directed to be released on bail on furnishing bail bonds of Rs.10,000/-(ten thousand) each with two sureties of like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saran at Chapra in connection with Garkha P.S. Case No.339 of 2017 corresponding to G.R. No.5837 of 2017.
