Petitioner seeks bail in connection with Jandaha P.S. Case No. 35 of 2018 registered for the offence punishable under Sections 392 and 412 of the Indian Penal Code. The prosecution case, as lodged by the employee of brick kiln owned by one, Mintu Kumar is that while he was sleeping with the staff Ratnesh Kumar, four miscreants in a Bolero car came and confined both of them in a separate room and took away the mobile and three tractors with trailor. It has been submitted by the learned counsel for the petitioner that he is innocent, not named in the First Information Report, bears no criminal antecedent and has been falsely implicated in the aforesaid case. He submits that only on the basis of confessional statement of one, Amarjit Kumar before

No.38288 of 2018(2) dt.06-07-2018 2/2 the police, which has no evidentiary value in the eye of law and that stolen tractor was found from the house of Kajal Rai, the petitioner has been made accused. He further submits that some of the co-accused named by Amarjit Kumar has been granted privilege of bail by co-ordinate Benches of this Court, one of them bearing Cr. Misc. No. 32356 of 2018 vide order dated 12.06.2018.
However, learned A.P.P. for the State opposes the prayer for bail.
Considering the facts and circumstances and the materials on record, let the petitioner, named above, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Hajipur, Vaishali in connection with Jandaha P.S. Case No. 35 of 2018, subject to the condition that one of the bailors would be close relative of the petitioner having sufficient immovable properties, who will file an affidavit stating his relationship with the petitioner.
