The petitioner seeks bail in anticipation of his arrest in connection with Pachrukhi (Sarai) P.S. Case No. 309 of 2019 dated 02.12.2019 instituted for the offence under Sections 272 and 273 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

It appears that 129.600 litres of liquor was recovered from behind the godown of one Sitaram Chaudhary.

There does not appear to be any recovery from the constructive possession of the petitioner. The petitioner has clean antecedents.

No.14730 of 2020(2) dt.11-06-2020 2/2 Considering the aforenoted facts, the petitioner is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-II-cum-Special Judge, Excise Act, Siwan in connection with Pachrukhi (Sarai) P.S. Case No. 309 of 2019, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Ashutosh Kumar, J) krishna/- U T
