JUSTICE DINESH KUMAR SINGH ORAL ORDER 19-02-2015 Heard learned counsels for the petitioners and the State.

The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 148, 323, 504, 435 of the Indian Penal Code and 3(1)(x) of the SC/ST

It is alleged that the accused persons came near the hut of the informant variously armed, abused by calling caste name and set the hutment of the informant on fire.

It is submitted by learned counsel for the petitioners that the writ application was preferred with regard to the same land which was disposed off with certain direction to the District Magistrate, Patna. Other accused persons have been granted anticipatory bail by this Court vide Cr. Misc. No. 18221 of 2014. The accusation is not specific against the petitioners and statements have been made in paragraph no. 3 of both petitions that the petitioners have no criminal antecedent.

The occurrence admittedly has not taken place in public view.

Considering the aforesaid facts, let the petitioners, above named, be released on bail in the event of arrest or surrender before the learned court below within a period of twelve weeks from today in connection with Athmalgola P.S. Case No. 48 of 2013 on furnishing bail bond of Rs.10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.
