The sole petitioner, having clean antecedent, which fact has been stated in paragraph no. 3 of the petition , apprehending his arrest in connection with Harnaut P.S. Case No. 110 of 2018 , registered for the offence under Section 290, 272, 273/34 of the Indian Penal Code, 1860 and Section 30 A of the Bihar Prohibition and Excise Act, 2016, has prayed for grant of bail in the event of his arrest or surrender. It was submitted by learned counsel for the petitioner that petitioner's name has come in disclosure made by two accused persons who were arrested by Police and from their possession about 10 liters of country made liquor was shown
Patna High Court Cr.Misc. No.36945 of 2018(2) dt.29-06-2018 2/2 to be recovered and it was indicated as if petitioner fled away and his name was disclosed by both accused. It has been argued that save and except confessional statement of co-accused, there is no other material to connect the petitioner in the present case.
Considering the fact that petitioner is having clean antecedent as well as the fact that he has been made accused on the basis of disclosure made by co- accused, in the event of his arrest or surrender within a period of six weeks from today, let the petitioner Jitendra Ravidas @ Jitendra Kumar be enlarged on bail on furnishing bail bond of Rs. 10,000/- ( rupees ten thousand ) with two sureties of the like amount each to the satisfaction of learned VIth Addl. Sessions Judge cum Special Judge ( Excise ) Nalanda at Bihar Sharif / concerned court in connection with Harnaut P.S. Case No. 110 of 2018 subject to the conditions as contemplated under Section 438 (2) of the Code of Criminal Procedure, 1973.
