JUSTICE GOPAL PRASAD ORAL ORDER 15-06-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. This is a petition for grant of anticipatory bail for the offences under Sections 307, 379 and other allied Sections of the I.P.C.
It is alleged that the police caught hold the persons engaged in selling of the liquor and English wine at the house of the petitioner no.1, Pintu Singh and in protest thereof several persons of the vicinity assembled and objected in taking seized English wine, bear and arrested Pintu Singh and 20-25 unknown persons and 18 persons named accused are alleged to have obstructed police in discharging their duty and assaulted them with lathi and danda and pelted stones and bricks on the police
Patna High Court Cr.Misc. No.22096 of 2016 (3) dt.15-06-2016 2/2 personnel causing injury to them.
Learned counsel for the petitioners submits that there is general and omnibus allegation and the injuries are said to be simple in nature.
Hence, having regard to the facts and circumstances of the case, let the petitioners, above named, in the event of their arrest or surrender before the court below within four weeks from today be released on bail on furnishing bail bonds of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of A.C.J.M., Sheikhpura, in Shekhopur Sarai P.S.Case No.21 of 2016 subject to the conditions as laid down under Section 438(2) of Cr.P.C.
