The petitioner seeks bail in a case registered under Sections 395/397 of the Indian Penal Code.

Allegation is that six unknown miscreants on the point of pistol looted away Rs.8,05,115/- from the ICICI Bank, Gobarsahi.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 07.12.2019 and has got no criminal antecedent. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is not named in the F.I.R. His name has come on confessional statement of co-accused.

Patna High Court CR. MISC. No.14544 of 2020(2) dt.03-03-2020 2/2 The petitioner has not been put on T.I.P. The alleged recovery of RS.15,000/- is claimed to be of the petitioner. Said recovered amount has also not been put on T.I.P. to ascertain whether the same is looted amount or not. Other co-accused has been granted bail vide Cr.Misc.No.11071 of 2020.

On behalf of the State, it is submitted that the petitioner is not named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Muzaffarpur in connection with Sadar P.S. case No.684 of 2019, G.R. No.5487 of 2019.
