JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-08-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case registered under Sections 30(a) of the Bihar Prohibition and Excise Act, 2016. The allegation is that 60 carton of foreign liquor were recovered from a house in presence of caretaker and he has disclosed the name of the petitioner.
Submission of the learned counsel for the petitioner is that he was arrested in connection with other case and he has been made accused in this case only on the basis of disclosure by caretaker. Nothing has been recovered from his house or from the possession of the petitioner. The petitioner is in custody since about 1 1⁄2 months.

No.38287 of 2017 (3) dt.24-08-2017 2/2 Having considered the facts and circumstances of the case, let, above named petitioner, be released on bail on furnishing bail bond of Rs. 25,000/- (twenty five thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J. 2nd cum Special Judge, Excise act, Buxar in connection with Brahmpur P.S.Case No.197 of 2017, subject to the condition that one of the bailors should be a local person having sufficient immovable properties within the jurisdiction of court concerned.
