An order dated 25.04.2020 passed by the Sub Divisional Officer -cum- Licensing Authority cancelling the petitioner's licence to run fair price shop under Bihar Targeted Public Distribution System (for brevity, BTPDS) (Control) Order, 2016 is under challenge in the present writ application. The petitioner has not availed the remedy of appeal available under the provisions of the said BTPDS (Control)

Learned counsel or the petitioner, after some argument, seeks permission to withdraw this writ application with a liberty to prefer appeal against the impugned order. If the petitioner prefers an appeal within four weeks from today with an application seeking condonation of delay, the appellate authority shall, after considering the petitioner's application for condonation of delay in accordance with law, decide the appeal within the time, as stipulated under the BTPDS (Control) Order, 2016.

This application stands disposed of as withdrawn accordingly.
