JUSTICE MADHURESH PRASAD ORAL ORDER 19-08-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner seeks bail in a case registered for the offence under sections 25(1-b) a, 26 and 27 of the Arms Act. The allegation in the FIR is that on some information regarding firing police went to the spot. In the meantime, two persons managed to flee away from the scene of occurrence on motorcycle and two more on Scorpio.

Learned counsel for the petitioner submits that he is in fact owner of the vehicle having a commercial number which he plies on hire. He further submits that at the relevant time, he had parked his Scorpio near the place of occurrence after dropping some customers. In the meantime, he was arrested by the police during checking. The petitioner denies

Patna High Court Cr.Misc. No.39295 of 2017 (2) dt.19-08-2017 2/2 possession of the loaded country made pistol and two live cartridges which are said to have been recovered form him. He submits that prior to the instant case, he has no antecedent and he is in custody since 14.4.2017.

In view of the aforesaid submissions, let the petitioner as mentioned above be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Begusarai in PS.Case No. -182 Year- 2017 Thana - BEGUSARAI TOWN District- BEGUSARAI, GR No. 1190 of 2017.
