ANJANA MISHRA ORAL ORDER 09-09-2016 Heard learned counsel for the petitioners, informant and learned counsel appearing on behalf of the State. The petitioners apprehend their arrest in connection with Palasi P.S. Case No. 12 of 2016 for the offences registered under Sections 147, 148, 149, 341, 323, 324, 307, 504, 506 and 302 of the Indian Penal Code.

Dairy of the present case was called for, which has since been received.

After hearing learned counsel for the petitioner, State and on perusal of the materials available in the case dairy, it appears that the petitioners had inflicted serious blows on the informant's side resulting into the death of one Manirul Haque and injury having been caused to Md. Bakar.

Patna High Court Cr.Misc. No.23512 of 2016 (5) dt.09-09-2016 In view of the fact that the prosecution case stands corroborated by the materials which have surfaced in the case dairy, I am not inclined to grant anticipatory bail to the petitioner. It is accordingly, rejected.

However, if the petitioners surrender in the court below and seek regular bail within a period of four weeks, the Court below may consider the regular bail application of the petitioners without being prejudiced by the present order. (Anjana Mishra, J) Jagdish/- U T
