This application is for grant of regular bail in connection with Hilsa P.S.Case No.609 of 2016, for the offences punishable under Sections 147, 148, 149, 302, 323, 324 and 109 of the Indian Penal Code.

Allegation against the petitioner is of assault to the deceased and there is allegation of assault against the co-accused also.

Submission of the learned counsel for the petitioner is that two persons have assaulted and there are two injuries on the person of the deceased and that allegation has not been attributed against the petitioner. The petitioner is in custody since 26.11.2016.

Patna High Court Cr.Misc. No.34142 of 2017 (3) dt.07-08-2017 2/2 Heard learned A.P.P. also, who has opposed the prayer for bail stating that the postmortem report also supports allegation and the injured has also supported the fact. Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant bail to the petitioner, however, the petitioner is in custody since long as such, the learned trial court is directed to expedite the trial of the petitioner.

With the aforesaid observation, this application is dismissed.
