NILU AGRAWAL ORAL ORDER 28-03-2019 Heard the learned counsel for the petitioner and learned counsel appearing on behalf of the State. Petitioner is languishing in judicial custody since 03.01.2019 in connection with Piro (Hasan Bazar) P.S.Case No.67 of 2017 for the offence alleged under Section 394 of the Indian Penal Code.
The prosecution case as lodged by the informant is that while he along with another teacher after taking out Rs.10,000/- from the bank was proceeding to the school three motorcycle borne criminals on pistol point snatched the money and fled away.
It has been submitted by the learned counsel for the petitioner that he is innocent, bears no criminal antecedent and during course of investigation on the confession of co-accused
Patna High Court CR. MISC. No.16439 of 2019(2) dt.28-03-2019 2/2 Sanjay Kumar @ Sanjay Yadav his name surfaced. He submits that no test identification parade has been done so far and the stolen money has also not been recovered from the possession of the petitioner. He further submits that two of the co-accused have already been granted the privilege of bail by coordinate Benches of this Court in Cr.Misc.No.28869 dated 28.06.2018 and Cr.Misc.No.55784 of 2018 dated 08.10.2018. However, learned APP for the State opposes the prayer for bail.
Considering the nature of allegations and the materials on record, let the petitioner, above named be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Piro (Hasan Bazar) P.S.Case No.67 of 2017 to the satisfaction of learned Additional Chief Judicial MagistrateIst, Ara, Bhojpur.
