Learned counsel appearing on behalf of the petitioner, after some argument, seeks permission to withdraw this application with a liberty to assail the impugned order dated 19.02.2021 passed by the Sub-Divisional Officer, Benipatti, Madhubani, cancelling the petitioner's licence under the Bihar Targetted Public Distribution System (Control) Order, 2016,
Patna High Court CWJC No.8282 of 2021(2) dt.10-02-2022 2/2 before the appellate authority. This application is permitted to be withdrawn with the liberty as sought.
The petitioner had presented this writ application for filing on 05.03.2021, soon after passing of the impugned order dated 19.02.2021. Accordingly, it is observed that if he prefers appeal within four weeks from today with an application seeking condonation of delay, the appellate authority shall be obliged to decide the petitioner's appeal on merit after condoning the delay, keeping in mind the fact that the petitioner was pursuing his remedy before this Court by filing the present writ application.
