Petitioner seeks bail in a case registered for the offences punishable under Sections 147, 148, 149, 302, 341, 323, 324, 326, 307, 504 of the Indian Penal Code and Section 27 of the Arms Act.
Submission of the learned counsel for the petitioner is that the F.I.R. would reveal that about 16 persons are named therein and specific allegation of commission of assault with Chura is against co-accused persons namely- (1) Meghnath Singh, (2) Bishundeo Singh and (3) Manoj Singh to deceased Pappu Singh, who was the brother of the informant. He further submits that considering other materials on record, co-accused
Patna High Court Cr.Misc. No.37609 of 2018 (2) dt.06-07-2018 2/2 Meghnath Singh has already been allowed by the co-ordinate Bench of this Court vide Annexure-5.
Allegation against the petitioner is that he was order giver and had caught the deceased at the time of the occurrence. The petitioner is in custody since 21.05.2018. Considering the entire facts, let the petitioner, above named, be released on bail after completion of the investigation, on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Uphara Police Station Case No.26 of 2017, subject to the condition that both the bailors shall be resident of the territorial jurisdiction of the court below and the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
