The petitioner has been in custody since 16.01.2018 in connection with Bihta P.S. Case No. 38 of 2018 registered for the offences punishable under Sections 399, 402 of the Indian Penal Code and Sections 25(1-b)a/26/35 of Arms Act. Learned counsel for the petitioner submits that the petitioner was found to be in possession of one country-made loaded pistol and a live cartridge. However, learned counsel for the petitioner further submits that the same was recovered from the Bolero vehicle and not from the conscious possession of the petitioner.
