Petitioner seeks bail in a case registered for the offence punishable under Section 392 of the Indian Penal Code. Informant has alleged in his FIR that he is an employee in financial company and on 24.03.2020 at about 5:00 pm he along with his two employees were going to Patna on motorcycle and as he reached near Beur More, three unidentified miscreants on the strength of arms looted his purse, mobile and motorcycle and fled away.

It has been submitted on behalf of petitioner that the name of the petitioner has surfaced in this case on the basis of confessional statement of co-accused Manager Rai. Except said confessional statement there is no any other incriminating

Patna High Court CR. MISC. No.32999 of 2021(3) dt.02-11-2021 2/2 material against the petitioner. No Test Identification parade of the petitioner has been done. Petitioner has been remanded in this case from Khagaul P.S. Case No. 91 of 2020 and is in custody since 17.12.2020.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 20,000/- with two sureties of the like amount each to the satisfaction of learned court below where the case is pending, in connection with Jakkanpur P.S. Case No. 201 of 2020, with following conditions:-

(1) Both the bailors shall be the resident of territorial jurisdiction of the learned court-below.

(2) The petitioners shall fully cooperate with the investigation / trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner. (S. Kumar, J) ranjan/- U
