The petitioner is apprehending his arrest in a case registered under Sections 341, 323, 504, 326, 307, 34 of the Indian Penal Code and 27 of the Arms Act.
The prosecution case, in brief, is that while the informant was returning home on motorcycle, the accused persons fired, as a result of which, the informant sustained fire-arms injury. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has been falsely implicated in the present case due to previous enmity. In a case, lodged after murder of brother of the petitioner, the informant is an accused. No allegation of assault
Patna High Court CR. MISC. No.17143 of 2019(2) dt.29-03-2019 2/2 is alleged against the petitioner.
On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-VI, Ara in connection with Narayanpur P.S.
