Heard the learned counsel for the petitioner and learned APP for the State.

The petitioner apprehends his arrest for the offences alleged under Section 366(A)/34 of the Indian Penal Code and Section 8 of the POCSO Act, registered in connection with Nautan P.S.Case No. 335 of 2021.

The learned counsel for the petitioner has submitted that the allegation of kidnapping is against Md. Irshad Maulvi and only allegation against this petitioner is that she has assisted in elopement of the victim. He has submitted further that independent witnesses have stated that there was love and affection between Irshad Maulvi and the victim and she herself had fled away with him.

Patna High Court CR. MISC. No.17869 of 2022(3) dt.23-01-2023 2/2 Though, the learned APP has opposed the prayer for anticipatory bail, but fairly admitted that the independent witnesses have stated that the petitioner has no hand in the alleged occurrence.

Considering the above facts and circumstances, let the petitioner above-named, in the event of her arrest or surrender within four weeks from the date of communication of this order, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge-VI-cum-Special Judge (POCSO), Bettiah, West Champaran in connection with Nautan P.S.Case No. 335 of 2021, subject to the conditions as laid down under Section 438(2) Cr. P.C.

Office shall ensure that all defects are removed by the petitioner within the stipulated time as provided hereinabove, failing which the matter shall be brought to the notice of this Court.
