JUSTICE ASHUTOSH KUMAR ORAL ORDER 20-07-2018 The petitioner seeks bail in anticipation of his arrest in connection with Raghunathpur P.S. Case No. 216 of 2017, dated 06.12.2017, instituted for the offences punishable under Sections 147, 148, 149, 324, 326 and 307 of the Indian Penal Code and Section 27 of the Arms Act. It has been alleged by the informant that when he had gone to urinate, the accused persons including the petitioner, variously armed, attacked him and resorted to firing. It has specifically been stated that one Ajay Gupta fired from his rifle, which hit the informant in his shoulders. Learned counsel for the petitioner has submitted

Patna High Court Cr.Misc. No.37192 of 2018 (3) dt.20-07-2018 2/2 that the allegation of firing, causing injuries to the informant, is attributed to Ajay Gupta and not to anybody else. The petitioner has been attributed with general and omnibus allegation of attacking the informant.

It has further been submitted that the other accused persons, similarly situated, have been granted anticipatory bail by different Benches of this Court. Considering the aforesaid facts, let the petitioner, above named, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-VIII, Siwan in connection with Raghunathpur P.S. Case No. 216 of 2017, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Ashutosh Kumar, J) Praveen-II/- U T
