2. The petitioners apprehend their arrest in a case registered for the offence punishable under Sections 115(2), 109, 352, 351(2), 74 and 3(5) of the B.N.S. and Section 27 of the Arms Act.
3. The prosecution case, in brief, is that on 14.11.2024 at about 9 AM, while husband of informant was sitting outside the house in the meantime, co-accused Shambhu Ram came there and shot husband of informant due to which he became unconscious and fell down. It is further alleged that all the F.I.R.
Patna High Court CR. MISC. No.17574 of 2025(2) dt.08-04-2025 2/3 named accused persons, including these petitioners, made indiscriminate firing and also damaged household articles as well as Bolero vehicle.
4. It is submitted by learned counsel appearing on behalf of the petitioners that petitioners are quite innocent and have committed no offence. As per F.I.R., specific accusation of firing is against co-accused Shambhu Ram. So far as these two petitioners are concerned, there are general and omnibus allegations and there is no specific accusation of overt act. Doctor has found the injuries, allegedly caused by these petitioners, to be simple in nature.
5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of anticipatory bail to the petitioners.
6. Considering the general and omnibus nature of accusation and nature of injuries sustained by the injured, the prayer for grant of anticipatory bail to these petitioners is allowed.
7. Accordingly, in the event of arrest/surrender within a period of eight weeks from today, let the above named petitioners be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like
