Having regard to the nature of allegation for offence under section 302/34 of the Indian Penal Code and that the petitioner is the second wife, whereas the deceased was the first wife, this Court would not be inclined to grant privilege of anticipatory bail to the petitioner, when it is the husband of the petitioner who is facing allegation of killing his first wife with the help and support of the petitioner, the second wife.

That being so, the prayer for anticipatory bail of the petitioner is rejected but then nothing said in this order shall come in the way of the petitioner in surrendering and making a prayer for regular bail.
