JUSTICE MIHIR KUMAR JHA ORAL ORDER 21-05-2015 Having regard to the allegation for offence under Section 302/34 of the Indian Penal Code and Section 27 of the Arms Act and that the petitioners have exactly same allegation as that of the accused Arun Kumar Singh, who has been only granted regular bail in Cr. Misc. No. 45775 of 2014, this Court would hold the petitioners also not to be entitled for privilege of anticipatory bail.

That being so, while the prayer for anticipatory bail of the petitioners is rejected, if the petitioners surrender before the court below and make a prayer for regular bail, the same shall be considered on its own merit specially in the background of the order passed by this Court while granting regular bail to Arun Kumar Singh.
