25-05-2016 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner apprehends his arrest in relation to SC/ST P.S. Case No. 61 of 2014 registered under Sections 341, 232, 379, 504/34 of the Indian Penal Code and Section 3(i)(iii) of the SC/ST (Prevention of Atrocities) Act.

The allegation is that the informant was at his Darwaja when Hari Lal Mistri and the petitioner, both in drunken state, came and started abusing him by his caste name.

Having considered the matter and the argument made by learned counsel for the petitioner, that even if petitioner abused the informant by his caste name,

Be that as it may, in the event of his arrest/surrender before the court below within four weeks, let the petitioner, namely, Nand Kishor Sutihar, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand only) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Purnea, in connection with SC/ST P.S. Case No. 61 of 2014, subject to conditions laid down under Section 438

(2) of the Code of Criminal Procedure.
