The petitioner is languishing in custody since 17.01.2019 in a case registered for the offences punishable under Sections420, 489(B) and 489(C) of the Indian Penal Code.

The prosecution case is that the informant Sachendra Singh, being a Police Officer received a secret information to the effect that Karu Ravidas, the petitioner is carrying fake currency notes whereupon, the petitioner was apprehended and from his possession, 1 note of 200 denomination, 75 notes of 100 denomination and 2 notes of 50 denomination of fake currency notes were recovered.

It is submitted by learned counsel for the petitioner

Patna High Court CR. MISC. No.16226 of 2019(2) dt.15-03-2019 2/2 that even assuming the accusation to be true, at best, the case under Section 489(C) of IPC is made out, which is bailable. A statement has been made in paragraph 3 of the petition that the petitioner is not having any criminal antecedent. Learned APP submits that huge fake currency notes were recovered from the possession of the petitioner. Considering the period under custody and a statement has been made in paragraph 3 of the petition that the petitioner is not having any criminal antecedent, let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Hilsa, District - Nalanda in connection with Islampur P.S. Case No. 18 of 2019.
