JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 13-07-2020 Heard learned Counsel for the petitioners and learned Additional Public Prosecutor for the State The petitioners are apprehending arrest in connection with Complaint Case No. 262 of 2018 in which cognizance was taken under Sections 406, 420, 506 and 504/34 IPC. Allegation against the petitioners as per the complaint petition is that they have declined to execute sale deed in favour of the complainant notwithstanding realizing money. Counsel for the petitioners submits that the alleged occurrence is dated 24.4.2015 and complaint case was filed on

Patna High Court CR. MISC. No.17645 of 2020(2) dt.13-07-2020 2/2 07.06.2018, approximately three years thereafter. Considering the aforesaid, the Court is inclined to grant anticipatory bail to the petitioners. Let the petitioners, above named, in the event of arrest or surrender within a period of one month from today, shall be released on bail on furnishing bail bond of Rs. 50,000/- (Fifty thousand) each with two sureties of the like amount each to the satisfaction of the ACJM, Bikramganj, District-Rohtas at Sasaram in connection with Complaint Case No. 262 of 2018, subject to the conditions laid down under Section 438(2) Cr.P.C.

During the pendency of the criminal case, the petitioners shall not alienate any land by way of sale deed to any person without permission of the Court below. (Anil Kumar Upadhyay, J) BT/- U T
