Petitioner apprehends arrest in connection with Complaint Case No. 946 of 2018 registered for the offence punishable under sections 323 and 498A of the Indian Penal Code and section 4 of the Dowry Prohibition Act.

Learned counsel appearing for the petitioner submits that petitioner has been falsely implicated in this case. It is further submitted that opposite party no. 2 desires the petitioner to purchase two katha land in her name at

Patna High Court CR. MISC. No.20516 of 2020(6) dt.06-12-2021 2/2 Aurangabad, but petitioner refused to do so. Petitioner has has to lookafter his old father. As a matter of fact, the opposite party no. 2 herself left the matrimonial house. Earlier also, opposite party no. 2 had lodged Complaint Case No. 26 of 2015 vide Annexure-2. Further, both are residing separately and they do not have any issue till today. Petitioner has no criminal history.

Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioner, above named, in the event of arrest or surrender within a period of four weeks from today, be released on bail on furnishing personal bond to the satisfaction of Chief Judicial Magistrate, Aurangabad in connection with Complaint Case No. 946 of 2018 subject to the conditions laid down under section 438(2) Cr.P.C.
