JUSTICE MOHIT KUMAR SHAH ORAL ORDER 23-06-2023 The present writ petition has been filed seeking the following reliefs:- "(1). (a) To issue a writ of mandamus commanding the respondents to refund the total amount to the tune of rupees 1,85,494/- of petitioner, which during course of his service, the petitioner was forced to deposit the same under different heads by the Regional Manager, Purnea Region of Uttar Bihar Gramin Bank without holding any enquiry and under coercion and threat for alleged lapses in service on his part, while he was posted as Branch Manager of
Patna High Court CWJC No.23319 of 2013(2) dt.23-06-2023 2/3 Ranipatra Branch of the Bank in between the period February 2007 to January 2011.
(b) To issue a further writ of mandamus commanding the respondents to pay adequate compensation to the petitioner for monetary loss and mental and physical torture suffered by him due to illegal and arbitrary action of the respondents.
(c) To issue further writ of mandamus, commanding the respondents to pay the entire due amount aforesaid of the petitioner along with their calculation charts and amount of interest at the rate of 18% per annum, since the date the amounts have been deposited, till the date of their payments." At the outset, the learned senior counsel for the petitioner seeks liberty on behalf of the petitioner to approach the Chairman, Uttar Bihar Gramin Bank, Muzaffarpur, for redressal of his aforesaid grievances. Liberty so sought is granted.
It is needless to state that in case appropriate representation is filed by the petitioner before the Chairman, Uttar Bihar Gramin Bank, Muzaffarpur within a period of four weeks from today, the same shall be considered in accordance with law and disposed off by the Chairman, Uttar Bihar Gramin Bank, Muzaffarpur, by passing a reasoned and a speaking order within a period of eight weeks, thereafter.
