The petitioners apprehend their arrest in Nauhatta P.S. Case No.11 of 2018 registered under Sections 341, 323, 376, 511 and 504/34 of the Indian Penal Code.

The victim alleged that petitioners and two others forcibly put her down on the ground with an intention to outrage her modesty but on alarm, her mother-in-law and others came. Only thereafter, the accused persons fled away. The learned counsel for the petitioners submits that there is some land dispute between two sides and on account of that, this false case has been lodged but it appears that there is no tangible material to show that the informant got any land dispute

Patna High Court Cr.Misc. No.39193 of 2018 (2) dt.06-07-2018 with the petitioner. The informant made specific allegation that both the petitioners and two others while she had gone to her field made attempt to commit rape after putting her down on the ground.

Therefore, I am not inclined to enlarge the petitioners on anticipatory bail. Accordingly, the same is rejected. (Prabhat Kumar Jha, J) Saurabh/- U T
