Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners apprehend their arrest in Belhar P.S. Case No. 196 of 2019, registered for the offences punishable under Sections 302, 201 and 34 of the Indian Penal Code. As per prosecution case, on the fardbeyan of Chaukidar, one dead body of unknown person was recovered and FIR has been lodged against unknown.

It is submitted that petitioners have been falsely

Patna High Court CR. MISC. No.16431 of 2020(2) dt.30-09-2020 2/2 implicated in this case. Petitioners are not named in the FIR. Name of these petitioners have come in this case merely on suspicion as they are having some dispute with the deceased. Save and except suspicion there is nothing against these petitioners. There is no eye-witness of the occurrence. Petitioner no. 1 is teacher in Middle School Chapriya Jasidih at Deoghar and petitioner no. 2 is wife of petitioner no. 1. Considering the facts aforesaid, the petitioners abovenamed, in the event of their arrest/surrender before the court below within a period of eight weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Banka in connection with Belhar P.S. Case No. 196 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
