04-05-2016 Heard Sri Mrityunjay Kumar, learned counsel, who was assisted by Mr. Nesar Ahmad, learned counsel for the petitioner.

The present petition has been filed with a prayer to restore C.W.J.C. No. 17939 of 2008, which stood dismissed on 13-09-2013, due to non-prosecution.

Learned counsel for the petitioner tried to persuade the Court that there was bona fide reason for non-appearance, however; after going through the ground set forth in the petition, the Court is not satisfied with the same.

The restoration petition stands dismissed.
