The petitioner, who is in custody, seeks bail in connection with Bheja P.S. Case No. 16 of 2017 registered for the offence punishable under Sections 457, 380/411 of the Indian Penal Code.

The allegation against the petitioner is that he was caught by the villagers while committing theft in the house of informant and carrying box on his head.

Learned counsel for the petitioner submits that the petitioner is quite innocent and has committed no offence rather he has been falsely been implicated in this case. It has further been submitted that petitioner has no criminal antecedent and he is in

Patna High Court Cr.Misc. No.45066 of 2017 (2) dt.21-09-2017 custody since 29.03.2017.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-III, Jhanjharpur, DistrictMadhubani, in connection with Bheja P.S.
