2. The petitioner seeks bail in connection with S. Kamal P.S. Case No. 313/2023 registered for the offence punishable under Sections 376(D) of the Indian Penal Code and Section 4/6/8 of POCSO Act.

3. The allegation is of committing rape. This allegation has been supported by the victim in her statement made under Section 161 of the Cr. P.C. and Section 164 of the Cr. P.C. The petitioner is in custody since 16.11.2023.

4. It has been submitted by Mr. Sharma, learned counsel for the petitioner, that the petitioner has been falsely implicated in this case. There is some discrepancy made in the statement in the F.I.R. and the statement made under Section

Patna High Court CR. MISC. No.22694 of 2024(2) dt.04-04-2024 2/2 164 Cr. P.C. He also submits that there is no medical report available in the case records till date.

5. Be that as it may, considering the allegations and the statement of the victim girl, I am not inclined to grant bail to this petitioner.

6. This application is dismissed.
